These Terms of Service apply to use of the ProOne Web website and to general enquiries made through the website. Project-specific work should be confirmed in a separate written quote, proposal, invoice, service agreement or statement of work.

By using this website or requesting services, you agree to use the website lawfully and provide accurate information when making an enquiry.

Website content is general information only. It is not a guarantee that a specific service, price, timeline, result or technical solution is suitable for every business.

Website design, hosting, domain, email, SEO, advertising and systems work can vary depending on business needs, existing platforms, technical access and third-party providers.

Quotes are based on information available at the time and final scope should be confirmed in writing.

Additional work, changed requirements, delayed feedback, missing information or missing access may affect pricing and timelines.

Deposits, progress payments or upfront payments may be required before work starts or continues.

Invoices must be paid by the due date shown on the invoice or agreed in writing.

Work may pause if payments are overdue. Ongoing services may be suspended or cancelled for non-payment, subject to any applicable law and written agreement.

Clients are responsible for providing accurate business information, timely feedback, approvals and access to domains, hosting, email, CMS, advertising accounts, analytics, software tools and other systems where needed.

Clients must ensure they have the right to use any supplied content, images, logos, files, trademarks, brand assets or other materials.

Clients should maintain backups of important business information unless ProOne Web has specifically agreed in writing to manage backups for that information or system.

ProOne Web may help manage services supplied by external providers, including hosting, domains, DNS, SSL, email, Microsoft 365, Google Workspace, analytics, advertising, payments, plugins, APIs, software platforms and client portal tools.

Third-party services have their own terms, pricing, renewal rules, service limits, outages, acceptable use rules and policies.

ProOne Web is not responsible for third-party outages, policy changes, price increases, account suspensions, rejected content, provider decisions or platform actions outside its control.

ProOne Web can help manage and support third-party services where agreed.

Clients remain responsible for choosing and approving domain registrations. Domain availability is not guaranteed until the domain is successfully registered.

Expired domains may affect websites, email, advertising and other connected services.

DNS changes can affect website and email availability. ProOne Web will take reasonable care when making agreed changes, but propagation delays and provider behaviour may be outside its control.

Hosting and email services may be subject to provider limits, fair use policies, acceptable use rules, security requirements and renewal terms.

Where permitted, ProOne Web may suspend services for unpaid invoices, misuse, security risk, provider requirements or breach of agreed service terms.

SEO rankings, traffic, leads, conversions, sales and advertising approvals cannot be guaranteed.

Advertising platforms such as Google, Meta or other networks may reject ads, suspend accounts, change policies or alter performance without notice.

Advertising spend is separate from ProOne Web management fees unless expressly stated in writing.

Clients are responsible for approving advertising claims, offers, landing-page content and any industry-specific compliance requirements that apply to their business.

Unless otherwise agreed in writing, the client receives usage rights to final paid deliverables once the related invoice has been paid in full.

Unpaid work may not be used, copied, published, transferred or implemented until paid for.

ProOne Web may retain reusable code, frameworks, templates, design systems, internal tools, methods, processes, know-how and non-client-specific materials.

Third-party fonts, plugins, themes, stock assets, software, APIs or platform tools may have separate licence terms that continue to apply.

ProOne Web may request permission to display completed work in a portfolio or case study.

No confidential client information will be intentionally published without permission.

Clients may request that work not be publicly displayed.

Timelines depend on client feedback, content, access, approvals, payment status and third-party systems.

Delays caused by missing information, delayed approvals, unavailable access, provider issues or changed requirements may affect delivery dates.

To the extent permitted by law, ProOne Web is not liable for indirect loss, loss of revenue, loss of profit, loss of data or business interruption arising from website use, delays, third-party services or technical issues.

Nothing in these terms is intended to exclude rights that cannot be excluded under Australian Consumer Law.

These terms are governed by the laws of Queensland, Australia, unless otherwise required by applicable law.

If a signed proposal, quote, invoice, statement of work, hosting agreement or service agreement conflicts with these website terms, the specific written agreement should apply to the extent of the inconsistency.
